Syllabus
Prerequisites: Orientation skills and subsequent work capacity:
a. with respect to the fundamentals of the general theory of law;
b. with respect to the categories and the main institutes of private, commercial, European Union and comparative law;
c. compared to the architecture of the system of sources, at private, public, european level.
Target skills and knowledge: 1. Knowledge and understanding - Students shall acquire a specific legal language, built on the interaction between the international, transnational, supranational-European and (Italian) national levels in order to understand the language and the meaning of the doctrine, of the norms and of the jurisprudence in the subject matter, taking into account that - above all with regard to international trade - law does not coincide with written rules. The illustration of the main international institutes and of the mechanisms regulating international trade will clarify this legal phenomenon, from one side partly regulatory and on the other side legal expression of the markets (thus approaching that phenomenon that some are summarized with "globalization of law").
2. Applying knowledge and understanding - The student shall be able to use and handle with sufficient security the basic doctrine, legislation and jurisprudence on the subject and master the basic mechanisms of legal regulation of the interests at stake in the markets.
3. Making judgments - The student shall be able to evaluate the outcomes, potential and limits - not only for practical purposes - obtainable from the application of the legal tools learned which can be used in the field.
4. Communication skills - The student shall be able to legally argue in Italian showing at the same time some familiarity with the main foreign terms of international commercial law consolidated in practice.
5. Learning skills - The student shall possess research methodologies and scientific-juridical knowledge on the subject, necessary to deal with technical-applicative investigations or specialized studies related to the subject.
Examination methods: Only oral examination.
Assessment criteria: correct assimilation and appropriate use of the specific language of the subject matter.
Course unit contents: The course is structured to provide the basic knowledge of both the public and private-law profiles of international trade. The first part of the course will illustrate the specific features of the international legal system, in particular the system of sources and guarantee mechanisms to determine the legal regulations governing, on the one hand, the international commercial agreements, on the other the so-called lex mercatoria, and then consequently the practices that have developed in European area. The main actors in the phenomenon of international trade (at the private, international, European, transnational and global level) will be examined, describing the reciprocal possibilities of interaction among them and the problems related to the underlying possible regulatory conflicts.
