Prerequisites: Regular attendance at classes is highly recommended.
Target skills and knowledge: The course is aimed at providing basic knowledge on Economic Analysis of Law and Law and Economics in order for students to reach a critical and economic-oriented perspective on private law.
Examination methods: Written test
Assessment criteria: The possibility of an early exam session will be granted only to those who have attended classes.
Course unit contents: -Introduction: role and functions of the Economic Analysis of Law (EAL). Comparative overview on common law- civil law systems
-Origins, development and diffusion of the EAL in the Italian legal tradition.
-Differences between Law and Economics and Economic Analysis of Law (G. Calabresi). Epistemological value of the "Law and..." approach.
- Coase thought, theorem and its variants. Property rules and liability rules.
-Tort of Nuisance and model rules by Calabresi and Melamed.
- Breach of contract and remedial tools
-Civil liability: typologies and quantification of damages
-Taste, values and merit goods. Commodification and commandification (G. Calabresi)
Planned learning activities and teaching methods: Lessons and seminars will be supported by multimedia tools, interactive debate and individuals or groups items of work. As a requirement of this course you will need to select a topic for a term paper based on cases and materials provided on the e-learning platform.
