Syllabus
Prerequisites: Commercial Law is introductory to Banking Law course.
Target skills and knowledge: This course aims to give students the basic knowledge about banking business and its supervision in Europe, but also at an international and domestic level, necessary for training of a financial jurist in an international dimension and useful, especially, for those who will consider as professional issues these in Financial Companies (Bank, investment’ enterprises, insurance), in Supervision Authorities, in International Law Firms.
Examination methods: For students who attended the lectures: it is granted the possibility to pass two intermediate exams, which consist in two written tests with some multiple choices questions and a few open questions, both in English language; who will successfully pass both intermediate exams could consider to have passed the exam; the final mark will be the average of the two intermediate results. The registration of the mark will take place esclusively during the official sessions of exams (« appelli ordinari »).

Optional oral exam for students who attended the lectures: Students who would have passed successfully both written tests will nevertheless have the possibility to modify their own mark with an oral exam to be hold during the exam session (appello ordinario) and that will focus, upon student’s choice, on a) ECB, Guide to banking supervision, November 2014 (exam to be hold in English language); or b) DE POLI, La contrattazione bancaria. Tra tutela della liquidità e obblighi di trasparenza, Padova 2012, da p. 189 a p. 263 (exam to be hold in italian). In that case, the average of the mark obtained at the written tests will be the basis for the final mark, without guarantee that it could be bettered or maintained following the optional oral exam.

Supplementary written exam for students who attended the lectures: Students who attended the lectures and won’t have presented themselves to and/or passed one of the two intermediate exams (with a passing mark equal at least to 18/30) shall complete it with an oral discussion, in English language, during the exam session (compulsory oral exam) which will focus both on the topics of the failed test and on one of the topics treated in the other test.

For students who didn’t attend the course: oral exam, in English language, or partly in English and partly in Italian, to be prepared on the reference texts (cf. infra).
Only those who would have attended at least 3/4 of the class lessons will be considered as students who attended the course.

Important notice, especially to Erasmus students: written tests will take place only onthe dates communicated at the beginning of the course.
Assessment criteria: Students will be valued on their knowledge on the topic and their ability to plan rightly the solution to complex questions.
Regular attendance of the course is required for the assignment of the degree thesis (also for the thesis in Diritto dei Mercati Finanziari) and for the participation to collateral initiatives (such as, for instance, participation to International Master for which shall be eventually required a letter of recommendation from the Professor - letter which will be delivered only to those who would have completed the entire course - or “stages” at Law firms, etc.)
Course unit contents: First part of the Course will focus on concepts of Bank, Bank’s activity, Supervision Authorities on Banks.
Second part of the Course will be instead given up to deepening of the subject , to Supervision Authority of Banks and of contracts and to the various forms of protection of the weaker contracting party in front of Banks, comparing Italian and UK regulations.
Planned learning activities and teaching methods: Each CFU corresponds to 6 hours of course (lecture or seminar) , to be hold in class.
Further to ordinary tutor activity, no other supporting teaching activities are foreseen.
Comprehension of the topics illustrated during the course will be facilitated by the use of slides and by the explanation of a precise glossary on English financial terms.
