Syllabus
Prerequisites: Commercial Law is introductory to Banking Law course
Target skills and knowledge: This course intends to give to students the basic knowledge about banking business and its supervision in Europe, but also at an international and domestic level, necessary for training of a financial jurist in an international dimension and useful, especially, for who will consider as professional issues these in Financial Companies (Bank, investment’ enterprises, insurance), in Supervision Authorities, in International Law Firms.
Examination methods: For students who attended the lectures: there will be the possibility to pass two intermediate exams, which consist in two written tests with some multiple choices questions and a few open questions in English language; who will successfully pass both intermediate exams could consider to have pass the exam, for the which will be assigned the average of both results gained as a final grade. Students who would have passed successfully both written tests will nevertheless have the possibility - if they wish to - to modify their own grade with an oral exam, still in English language, to be hold during the exam session (appello ordinario) and that will focus on topics analyzed during the course and that will serve to ensure the students’ ability to discuss - not only in a superficial way - the principal problems of the subject. In that case, the average of the grade obtained at the written tests will be the basis for the final grade, without guarantee that it could be bettered or maintained (the oral exam is optional).
For the students who won’t have presented themselves to and/or passed one of the two intermediate exams (with a passing grade equal to 18/30) shall complete their own grade with an oral discussion, in English language, during the exam session (oral exam obligatory) which will focus on the topics of the test which wouldn’t have been passed and on one of the topics treated in chapters 1, 2, 3 and 4 of the reference text (cf. infra).
For students who didn’t attend the course: oral exam, in English language, to be prepared with the reference text (cf. infra).
Only those who would have take part to at least 3/4 of the class lessons will be considered as students who attended the course.
It shall be specified, especially to Erasmus students, that written tests will occur only at the dates communicated at the beginning of the course.
Assessment criteria: Students will be valued on their knowledge on the topic and their ability to plan rightly the solution to complex questions.
Having regularly attended the course is required for the assignment of the degree thesis (also for the thesis in Diritto dei Mercati Finanziari) and for participation to collateral initiatives (such as, for instance, participation to International Master for which shall be eventually required a letter of recommendation from the Professor - letter which will be delivered only to those who would have completed the entire course - or “stages” at Law firms, following an organized schedule of the chair, etc.)
Course unit contents: In the first part of the Course will be examined concepts of Bank, Bank’s activity, Supervision Authorities on Banks.
Second part of the Course will be instead given up to deepening of the subject , to Supervision Authority of Banks and of contracts and to the various forms of protection of the weaker contracting party in front of Banks, in a comparison between Italian and UK regulations.
Planned learning activities and teaching methods: Each CFU corresponds to 6 hours of course (lecture or seminar) , to be hold in class.
Eventual practice could be offered previous Professor’s evaluation.
Further to ordinary tutor activity, no other supporting teaching activities are foreseen.
Comprehension of the topics illustrated during the course will be facilitated by the use of slides and by the communication of a precise glossary on English financial terms.
Additional notes about suggested reading: For students who will attend the lectures, set of university lecture notes and material will be indicated a little at a time during the lectures.
For students who will pass the exam in English language without having attended the lectures (Cd. modalità di esame), we highly advise to prepare the exam with the following text.
