Syllabus
Prerequisites: The exam of International Law is a prerequisite. Basic notions of EU Law are also recommended.
Target skills and knowledge: The course aims at describing and analyzing the international legal regime on trade of goods among States (rectius: custom territories). Consequently, the course does not make reference to transnational relationships among private subjects, since such relationships are governed by the private international law.
Initially, the analysis shall mainly focus on the development of the matter, starting from the General Agreement on Tariffs and Trade (GATT, 1947) to the establishment of the World Trade Organization (WTO, 1994) and the system of agreements related to it.
Secondly and further in detail, the programme will examine and evaluate the obligations resulting from the relevant legal system. Under this section, special attention shall be paid to the rules and procedures regarding the settlement of disputes and related economic sanctions.
The course also aims to develop the students' ability to learn the matter through the direct use and discussion of the pertinent legal texts and cases.
Examination methods: Oral exam including the discussion of a case chosen and presented by the Candidate.
Course unit contents: 1. Genesis and evolution of the GATT.
2. The results of the Uruguay Round: general aspects.
3. The establishment of the WTO: membership, structure, functions.
4. Tariff protection. The Most-Favoured-Nation Treatment and its exceptions.
5. Antidumping and countervailing duties.
6. Quantitative restrictions. Safeguards.
7. Market access. National treatment.
8. Subsidies.
9. General exceptions and waivers.
10. Settlement of disputes: general aspects.
11. The DSU regime.
12. Compensation, suspension of concessions and economic sanctions
Planned learning activities and teaching methods: Students are invited constantly to refer to legal instruments which are of relevance according to the subject being examined. More specifically, references to the GATT, the Agreement establishing the WTO and the Understanding on Rules and Procedures Governing the Settlement of Disputes are required. References are expected also to the French and Spanish (official) versions of the texts.
