Syllabus
Target skills and knowledge: The course aims at developing a systematic capacity of reflecting on legal experience. This will be done through the confrontation between different legal systems, and having regard to the concrete legal praxis. For those who are interested, an elective part of the course will be held in English; those who attend the lectures in English will benefit of an equivalent waive of lectures in Italian.
Examination methods: The active attendance of classes is strongly encouraged. Classes will focus on hard cases and issues, which will be addressed through discussions and debates among students.
A supplementary weekly lecture will be held in English, for those who are willing to attend it. Once the students who attend the supplementary lectures reach the 9 credit-hours target, they end the course and will be examined on the lectures they attended.
Assessment criteria: Interview. The students who have attended the course will be examined on the topics that were taught during classes.
Those who attend the lectures in English can ask to be examined in English, limitedly to the parts that were treated in English.
Course unit contents: We will focus on the most debated issues in foreign public laws, in order to capture salient informations to address Italian problems.
Planned learning activities and teaching methods: We will consider the prevailing dynamics of contemporary constitutional models. We will consider the evolution of election laws as well as of models of States and of Government in the European Context, with special regard to the evolutionary trends in the Italian context. This will help the understanding of the modifications of the Italian legal system. Contemporary struggles call for a study of the legal regimes of Middle East. A deep consideration of the Muslim legal culture and of Middle Eastern society will make us understand the reasons of the struggles.
Finally, we will consider the problematic relationship between law, politics and conscience, in a comparative perspective. This will lead to a broad understanding of contemporary Western constitutionalism.
