Syllabus
Prerequisites:
Target skills and knowledge:: This class will allow students to acquire basic knowledge about how the cognitive system works. In particular, learning about thinking and memory processes will make students able to understand how individuals make decisions. More in detail students will learn how people make evaluations about whether and event will take place or not and about the cognitive factors that influence decisions in everyday life and in the specific context of law.
Course unit contents:
Planned learning activities: First of all the program will cover thinking processes, reasoning biases, and systematic distortions in inference processes, with particular focus on hypothesis test biases, counterfactual thinking, memory errors, amnesias, and false recollections as they apply to the law field.
When discussing judgment strategies a particular importance will be given to the heuristics that people in general and juridical agents in particular use to make evaluations and estimates. These processes will be discussed both looking at the results of laboratory experiments and describing real cases drawn from the law field.
When discussing decision making processes the focus will be on the standard theory of choice. The analysis of this theory will make clear why it is unable to predict the actual behavior of people because of the gap existing between its normative and descriptive power. This will lead to the analysis of the classical paradoxes use to demonstrate the falsification of rationality principles.
During the class there will be a thorough discussion of Prospect Theory and of the Framing Effect both in relation to the judges and lawyers behavior as well as in relation to contexts in which it is fundamental to evaluate risks or buy insurance coverage.
In addition, the class will cover the analysis of decisions under conflict and which reasons could lead a decision maker to choose an intermediate, or compromised option. The class will also touch issues as the mental representation of costs and benefits, the tendency to overweight past decisions, and the biases characterizing group decision making like in popular juries.
Finally, the program foresee the analysis of the role emotions have on the decision process and the strategies of negotiation used when two counterparts commit to solving a conflict.

Teaching methods: Frontal lessons in class in which beside the presentation of theories and concepts of decision making, the instructor will lead discussions about the experimental data presented.
Assessment criteria: At the end of the class proficiency will be assessed with an oral test.
